I am often contacted by citizens of the Philippines who tell me that they have been in a long term relationship with an Australian. Usually it has been a long distance relationship, with the Australian visiting the Philippines maybe once or more times every year. Occasionally and where possible, the Australian has even been living for extended periods of time in the Philippines with their partner.
I am then told that the couple now want to move to Australia on a permanent basis. This might be because they think it might be a better life in Australia with more opportunities, better earning capacity and possibly a better education and future opportunities for their children.
And so the question now becomes: Is it possible to move to Australia? If so, what are our options? What is the best visa or combination of visas for us considering our individual situation?
The first thing to remember is that everyone needs a visa to travel to Australia. This is whether you intend to just visit, or to migrate permanently. The 2nd thing is that the Philippines is classified as a “high risk” country by Australian Immigration (DOHA). So obtaining even the simplest of Australian visas is not easy.
When looking to migrating to Australia you may want to look at a Partner visa. There are different types of Partner visa for different situations. For example, if you and your Australian partner are eligible, it may be possible to apply for one of these visas in the Philippines. Or if you are able to travel to Australia, you may then be able to apply for a type of Partner visa in Australia. Things also change depending on if you are engaged, married, or in a de facto relationship. Everything will ultimately depend on your individual circumstances and the circumstances of your Australian partner.
In your Partner visa application it may also be possible to include dependent children from a prior relationship. However, again, as with everything else mentioned above, you need to make sure that they are eligible, and also meet international child protection guidelines.
