A Fiancé visa Australia is a type of Australian Partner or Relationship visa.It is also known a Prospective Marriage visa. It is a visa for a couple that are engaged to be married. The couple need to be in a genuine and continuing relationship, but are not married. The couple can be in either a different sex or same sex relationship. The Applicant for this visa can apply on the basis of being in the engaged relationship with their fiancé (the Sponsor), who is an Australian citizen or Permanent Resident. If the visa is granted then the holder will be able to migrate to Australia to live with their fiancé, but they will need to meet the conditions of the Fiancé visa to remain eligible. This is discussed further below.
The Australian Government Department of Home Affairs has increased the base cost of the visa over the years, and the current Visa Application Charge is $7715. This fee must be paid in full at the time of lodgment of the application. If you want to add a dependent child there are added fees.
As mentioned above, to be eligible for a Fiancé visa, the Applicant must be in an engaged relationship with an Australian citizen or Permanent Resident. The couple must be in a genuine and continuing relationship and provide evidence of this. There are a number of other eligibility criteria including character and health requirements, as well as certain restrictions. If the Fiancé visa is granted then it will be valid for 9 months. During this time the Applicant must first travel to Australia, then get married to their Australian fiancé, and finally they will be required to prepare and submit a Marriage visa application. Make sure that you look carefully at the Fiancé visa Australia requirements.
This is a good question and one that I get asked very often. The answer really depends on your circumstances. If you are in an engaged/fiancé relationship then the Fiancé visa is probably your best option. You might consider getting married to your fiancé and apply for a Spouse visa, but you should first seriously consider the requirements of the Marriage visa which are different and can be more onerous than a Fiancé visa. Another thing to consider as part of this question is – where are you located at the moment – you can only apply for a Fiancé visa if you are outside of Australia. So, if you are in Australia you will need to look at either another option or you will need to leave Australia before you apply.
No. As mentioned above, you can only apply for a Fiancé outside of Australia, and after submitting your application you will not be given any special permission to enter Australia while you wait for you application to process. If you want to enter Australia during the processing of your application (for example to spend time with your fiancé) then you will need to apply for and obtain some sort of temporary visa.
No. As mentioned above, you can only apply for a Fiancé visa outside of Australia, and after submitting your application you will not be given any special work rights in Australia for while your application is processing.
The Fiancé visa Australia processing time can vary greatly. Generally speaking, it may take somewhere between 1 to 1.5 years for a Fiancé visa application to be decided. The Fiancé visa Australia processing time can depend on: whether your application is complete or not, whether any complex or unusual issues exist and have to be dealt with, whether or not your application is a borderline case or not, how many applications are in front of you in the queue, etc…
